Subject: Data Protection Policy

Introduction

The Company recognizes the importance of personal information and other information (hereinafter called the “Information”) so that you can be confident that the company is transparent and responsible for collecting, use or disclose your information in accordance with the Personal Data Protection Act B.E. 2562 (hereinafter called the "Personal Data Protection Act") and other relevant laws.

The company therefore prepared this policy to clarify details about the collection, use or disclose (hereinafter called the “process”) personal data processed by the Company including officer and related persons who operate on behalf of the company. The details are as follows.

  1. The regulation shall take effect from July 22, 2022.
  2. This company regulation supersedes any previous regulation regarding company time record issued by the company.
Scope of Enforcement
  1. The Data Protection Policy applies to personal data of persons who have relationship with the Company in the present and future which personal data is processed by the Company, officers, employees, or other party operated by the Company and includes parties or third parties who process personal data on behalf of the Company (hereinafter called the “Data Processor”).
  2. Personal data shall include the personal information of the following persons
    1. Individual Customer
    2. Employee, Officer or Operator or employee of the Company
    3. Partner, and service provider
    4. Director, attorney, representative, agency, shareholder, employee or other persons having a similar relationship of a legal entity with a relationship with the Company.
    5. Service users of the company
    6. Visitor or user of website http://www.iharanikkei.co.th/ including application system, device or other communication channel is controlled by the Company.
    7. The other person at the company is collected personal information such as job applicant, family of officer, guarantor, insurance policy beneficiaries, etc.
  3. Personal Data in accordance with clause 2.2.1-2.2.6 collectively referred to as “Data Subject”.
  4. The Company may require a privacy notice (“Notice”) for its products or services in order to inform the data subject who is a service user to acknowledge Personal Data that processed, purpose and legitimate grounds for processing, period of retention of personal information including the right to personal data that data subject has in particular products or services.
  5. For personal data collected before the Personal Data Protection Act B.E. 2562 came into force, the Company can continue to collect and use that personal data for its original purpose. By disclosing and performing other actions other than the collection and use of personal data above, it shall comply with the Personal Data Protection Act B.E. 2562 and related laws.
Definition
  1. Company means Iharanikkei Chemical (Thailand) Co., Ltd.
  2. Personal Data means any information relating to an identifiable person, either directly or indirectly, but excluding the information of a deceased person in particular.
  3. Sensitive Personal Data means personal data as provided for in Section 26 of the Personal Data Protection Act B.E.2562 such as race, ethnicity, political opinion, belief, religion or philosophy, sexual orientation, criminal record, health information, disability, labor union information, genetic data, biological data, or any other data which may impact the data subject in a similar manner, as stipulated in the Personal Data Protection Committee’s announcements.
  4. Data Processing means any action or process which deals with personal data or a set of personal data either by automated method such as storage, recording, organizing, structuring, preserving, changing or modifying, receiving, considering, disclosing through forwarding, dissemination, or any action arranging, merging, deleting or destroying etc.
  5. Data Subject means an individual person to who owns personal data that the Company collects, uses, or discloses.
  6. Data Controller means a person or a juristic person, any government agency, agency or organization that defines the purposes and methods of processing personal data including duties to make a decision regarding the collection, use or disclosure of personal data.
  7. Data Processor means natural person or juristic person, any government agency, agency or organization who processes personal data in connection with the collection, use or disclosure of personal data on the order or on behalf of the Personal Data Controller. However, Data Processor is not the controller of the personal data.
  8. Personal Data Protection Policy means the policy that the Company has established to make the data subject aware of the Company’s processing of data and a number of relevant issues as stipulated by the Personal Data Protection Act B.E. 2562 and related laws.
  9. Personal Data Breach means leakage or breach of security measures against personal information, causing damage, loss, alteration, unauthorized disclosure, or access to the personal information used.
  10. Cookies means small computer files that store temporary files of necessary personal data only for the convenience and facilitation of communication while accessing the Website.
The Source of Personal Data Collected by the Company

Company shall collect personal data such as specific personal information, information related to personal life or personal interests, financial information, sensitive personal information which is to be based on the following sources and principles.

  1. Personal Data that the company collects directly from the data subject through various service channels, for example, filling out of via application forms, either in paper form or online, responses to surveys conducted by the Company, applying for jobs, signing contracts or documents conducting surveys or use other products, services or service channels maintained by the Company or when the data subject communicates with the Company; or through other communication channels that are controlled by the Company, etc.
  2. Data that the company collects from the data subject who access to website, software, application in accordance with service contract, products or services of the company such as tracking the behavior of using the website, the use of cookies or from software on the device of the Personal Data Subject, etc.
  3. Personal Data that the company collected from other sources in addition to the personal subject that such sources have the authority or consent of the personal data subject to disclose the information to the Company.

This also includes cases where you provide a third-party personal data to the company. In this case, it is your responsibility to inform details under this data protection policy or related announcement of products or services, as the case may be, to such persons as well as obtaining consent from that person if it is a case where consent is required to disclose information to the Company.

In the case that the Data Subject refuses to provide information that is necessary to provide the Company's services. It may result in the Company being unable to provide that service to the Data Subject of such personal data in whole or in part.

The Company may consider using other legal bases other than those set forth above for the provision of services or the Company's business operations, subject to legal rules

In the case that it is necessary for the Company to collect your personal data to comply the contract, legal duty, or for the necessity of entering into a contract, if you refuse to provide personal information or object to processing for the purpose of the activity, it may result in the Company being unable to perform or provide the services as you have requested in whole or in some part.

For the purpose of establishing legal rights and litigation Dispute resolution and judicial proceedings litigation as well as the execution of a subpoena, court order, or arbitration award.
Using and Disclosure of Personal Data
  1. Principle

    The use and disclosure of personal data by the Company shall be in compliance with the purposes and principles stated in item 7. Principles of personal data collection, the Company may disclose personal data to agencies or third parties with the consent of the data subject only to the extent that it is necessary to do so, unless such disclosure is permitted by law. Personal data may be disclosed to third parties, organizations or government agencies as follows:

    2. Contractual parties, service providers and business partners of the Company such as companies in the same business group, companies in the banking business group, companies in the insurance business group, companies in the information technology service business group, companies in the electronic commerce business group (e-commerce), and companies in the rental service group.

    6. Government agencies with legal authority such as the Anti-Money Laundering Office, the Office of the National Anti-Corruption Commission, the Office of the Narcotics Control Board, the Social Security Office, the Revenue Department, the Legal Execution Department and courts.

Transmission or Transfer of Personal Data to Other Countries

The Company may transmit or transfer personal data collected from the data subject to its affiliates, group companies, or any other service providers outside of Thailand, such as cloud computing service providers with platforms or servers located outside of Thailand, data processors, Platform as a Service (PaaS), and so on, for the purposes described in this privacy policy, and the Company will ensure that such destination countries have adequate standards for personal data protection.

However, in the event that the destination country does not have adequate personal data protection standards, the Company will ensure that the transmission or transfer of such personal data includes adequate and appropriate personal data protection measures in accordance with the Personal Data Protection Act B.E. 2562 and related laws as follows:

  2. Notify the data subject and obtain consent in the case that the destination country has insufficient standards for personal data protection.

Personal Data Located in the Oversea

In the event that personal data of a data subject located in Oversea is transferred to the Company for the purpose of providing the service, the Company will process to ensure that such data transfer is carried out in accordance with the general provisions of the protection of personal data such as transfers under Standard Contractual Clauses or the Binding Corporate Rules.

Furthermore, the Company will take appropriate measures to facilitate the exercise of personal data subject rights and legal remedies under applicable laws.

Period for Personal Data Retention

The Company will retain personal data only for as long as it is necessary for the purpose for which it is collected according to the following periods

  1. Personal data will be kept for the periods stipulated by laws specifically relevant to retention of personal data such as the Accounting Act B.E. 2543, Anti-Money Laundering Act, B.E. 2542, Act on Commission of Offences Relating to Computer, B.E. 2550 and the Revenue Code
  2. In cases where the retention period for personal data is not specified by relevant laws, the Company will determine the period necessary and appropriate for its operations.
  3. At the end of such period, the Company shall delete, destroy, or anonymize the personal data.

However, in the case of a dispute in exercising any right or lawsuit in connection with your personal data, the Company reserves the right to keep that information until the dispute has been finalized by order or judgment.

Providing Services by Third Parties or Outsourcing

The Company may delegate or hire third parties (Data Processor) to process personal data on its behalf. Such third parties may provide services in a variety of ways, including hosting, Outsourcing, Cloud Computing Service Provider, Information Technology Service Provider, or supporting the Company's internal service or administration (such as processing related transactions, debt collection, providing information services to customers, preparation of salary slips, conducting surveys, customer data analysis, etc.)

Delegating to third parties to process personal data on behalf of the Company as a data processor, the Company shall provide an agreement which specifies the rights and obligations between the Company and the person assigned by the company. Such persons, as data processors, are obliged to process personal data only to the extent specified in the agreements and orders of the Company without being able to process it for any other purpose.

In the case that data processor assigns third party to process personal data on behalf of the data processor, the Company will direct the data processor to provide a documentary agreement between the data processor and third party in a form and standard that is not lower than the agreement between the Company and data processors.

Personal Data Security

The Company has established appropriate personal data security measures to prevent the loss of, unauthorized and unlawful access to, and the use, modification, correction or disclosure of personal data in accordance with the Company's policies and procedures for information security as well as applicable laws.

In case where the Company has engaged an agency or a third party to perform work related to the collection, use or disclosure of personal data of the data subject, it shall require the agency or the third party to keep the personal data confidential and secure, and to prevent the collection, use or disclosure of such personal data for any purposes other than specified in the scope of engagement or for any unlawful purposes.

External Website or Service Connections

The company service may link to third-party websites or services. External website or service may publish a personal data privacy policy that differs from the company's policy. Therefore, the data subject shall study the privacy policies before using any such website or service. The Company is not affiliated with and has no control over the privacy protection measures of such websites or services, and cannot be held liable for the content, policies, damages, or actions caused by third-party websites or services.

Rights of Data Subject

This policy is established to assure data subject that they can use the following rights available to them under the Personal Data Protection Act, B.E.2562.

  1. Right to withdraw consent, in the case that the data subject has given consent to the Company for collecting, using or disclosing personal data (whether that consent was given before or after effective of the Personal Data Protection Act B.E.2562). The data subject has the right to withdraw their consent throughout the period that your personal data is kept by the company unless there is a restriction on rights by law for the company, that is necessary to keep the data or there is still a contract between the data subject and the company. The Company is obliged to continue to keep the information or there is still a contract between you and the Company.
  2. Right of access, the data subject has the right to request access to the personal data of data subject and has the right to request the Company to copy and disclose such personal data unless the company has the right to refuse your request on bases of law or court order or in the case that the use of your rights will have an effect that may cause damage to the rights and freedoms of others.
  3. Right to rectification, the data subject has the right to request the Company to rectify incorrect or incomplete data, not complete and not cause misunderstanding.
  4. Right to erasure, the data subject has the right to request the Company to delete or destroy the personal data or make your personal data unable to identify the individual who is the data subject. However, the use of the right to delete or destroy this personal data must be under the conditions prescribed by law.
  5. Right to restriction of processing, the data subject has the right to request the Company to restrict the use of their personal data for certain reasons as following:
    1. When in the company perform verifications at the request of the data subject to correct personal data, complete and up to date data.
    2. Personal data of the data subject is unlawfully collected, used or disclosed.
    3. When the personal data of the data subject is not necessary to keep personal data for the purposes for which the company has informed of the collection. But the data subject requests the company to keep that information for the purpose of using its legal rights.

  7. Right to object, the data subject has the right to object to the collection, use or disclose personal data unless the company may refuse base on a legitimate request

However, the Company may refuse the use of the above rights by the data subject, provided that the rejection is in accordance with the Company’s rules that are not in violation of the law.

The data subject can use the above rights by submitting a request to the Company through contact channels, the Company will deal with your request no later than 30 days from the date the Company receives the request. Rejecting the above request, the Company will inform the data subject about the reason for the refusal.

The Data subject has the right to file a complaint in case where the data controller or the data processor, including employees or service providers violates the Personal Data Protection Act B.E. 2562, or related law.

Penalty for Non-Compliance with the Personal Data Protection Policy

Failure to comply with the policy may result in an offense and subject to disciplinary action in accordance with the Company's rules. (For employees of the Company) or in accordance with the personal data processing agreement (for Data Processor) as the case may be and relationship with the Company and may be subject to penalties as prescribed by the Personal Data Protection Act B.E. 2562 including secondary laws, rules, regulations, and relevant orders.

Complaints to Regulators

In the case that you find that the company failure to comply with personal data protection laws, you have the right to complain to the Personal Data Protection Committee or regulators appointed by the Personal Data Protection Committee or by law.

  6. In the case that violates to all policies, regulations, procedures, manuals, and announcement, you are subjected to severe disciplinary actions. The company reserves the right to terminate employment contract without advance payment and severance pay, and takes legal actions by Thailand law at the right time as to any compensation cost or any damages cost which may result from performance everywhere which asserts its legal right.
  7. The supervisor is responsible to take care, inspecting, looking around, coaching subordinates to consecutively follow all policies, regulations, procedures, manuals, and rules that are identified as company has official announcement.
  8. Others as specified in the procedures.

The company reserves the rights to review, change or cancel any sections of this regulation as and when appropriate. In the case that the company or the person as assigned may be set otherwise to comply with that.
